Licensing of debt collectors in Queensland

The Debt Collectors (Field Agents and Collection Agents) Act 2014 (Queensland) will commence on 1 December 2014.

The Act establishes regulations specific to the debt collection industry including conduct standards for debt collectors.

The Act replaces the positive licensing regime previously imposed on collection agents (who perform their activities without face-to-face contact with the debtor) with a negative licensing regime, while maintaining the positive licensing regime for the field agent sector.

The Debt Collectors (Field Agents and Collection Agents) Regulation 2014 (Qld) requires field agents who repossess chattels to sign a statement outlining specified particulars, to give a copy of the statement to the field agent’s client, to give a copy of the statement to the person from whom the chattel was repossessed and to keep a copy at the field agent’s place of business or registered office.
