Western Australia has arranged for its Co-operatives Amendment Act 2016 and Co-operatives Amendment Regulations 2016 to commence on 1 January 2017.
The Co-operatives National Law (CNL) already applies in NSW and Victoria (both on 3 March 2014), South Australia (22 May 2015), Northern Territory (1 July 2015) and Tasmania (1 September 2015).
The Australian Capital Territory (ACT) Government is considering legislation which proposes to repeal the ACT’s current Co-operatives Act 2002 and adopt the CNL.The ACT Government is presently consulting with co-operatives registered in the ACT and other stakeholders about this proposal.
On 30 January 2015, Queensland withdrew from the Australian Uniform Co-operative Laws Agreement which provides for the introduction of the CNL or alternative consistent legislation by the States and Territories. Following a change of Government in 2015, Queensland is considering whether the existing law in Queensland should be changed. In the interim, the Co-operatives Act 1997 (Qld) continues to apply.
