AFCA’s approach to multiple similar cases

Following the Federal Court decision in September 2022 that Dixon Advisory and Superannuation Services Limited (Dixon Advisory) failed to act in their clients’ best interests and failed to provide advice appropriate to their clients’ circumstances, the Australian Financial Complaints Authority (AFCA) received multiple complaints against Dixon Advisory.

AFCA says it received more complaints against Dixon Advisory than about any other firm in its five years of operation with over 1900 complaints received to date.

Dixon, which is under administration, had its Australian Financial Services licence cancelled in 2023.

AFCA has published a  Dixon “lead decision” that considers the core issues and principles that can be applied to similar cases.

The lead decision does not mean every case will have the same outcome, however, because every case will still be determined on its individual merits.

The Dixon lead decision will help guide decision-making and assist efficient progress of the remaining cases involving Dixon.
